Terms & Conditions
§ 1 Scope
These General Terms and Conditions apply to all contracts between SENSOR TECHNIK Kft. (hereinafter 'WOIMS' or 'Provider') and the client (hereinafter 'Client') for the use of WOIMS's website rental service. Deviating conditions of the Client are not valid unless WOIMS expressly agrees to them in writing.
§ 2 Subject matter
WOIMS provides the Client with a professionally designed, hosted and maintained website on a rental basis. The scope of services includes, depending on the chosen package: design and development of the website, hosting on WOIMS VPS servers, ongoing technical maintenance and security updates, basic SEO settings, and optional additional services such as content creation, advanced SEO optimisation and custom features.
§ 3 Contract conclusion and term
The contract is concluded upon WOIMS's written order confirmation. The minimum term is 12 months. After the minimum term, the contract automatically renews for a further 12 months each time unless terminated in writing with 3 months' notice before the end of the term.
§ 4 Remuneration and payment
Remuneration consists of a one-time setup fee and a monthly rental fee as agreed in the respective offer. The monthly rental fee is due in advance on the first of each month. In the event of late payment, WOIMS is entitled to temporarily suspend the service. All prices are exclusive of applicable VAT.
§ 5 Service delivery
WOIMS undertakes to provide the agreed services with due care and professional competence. The stated delivery times (5–10 business days for START and STANDARD, 3–8 business days for PREMIUM) are guidelines and not binding deadlines. WOIMS is entitled to engage third parties for service delivery.
§ 6 Client cooperation
The Client undertakes to provide WOIMS in a timely manner with all information, texts, images and other materials required for the creation of the website. Delays attributable to a lack of client cooperation are not the responsibility of WOIMS. The Client is solely responsible for the legality of the content they provide.
§ 7 Copyright and usage rights
WOIMS grants the Client a simple, non-transferable right of use to the created website for the duration of the contractual relationship. Upon termination of the contract, all usage rights expire. The source code and all design elements created by WOIMS remain the property of WOIMS. The Client may not transfer the website to other hosting systems without the express consent of WOIMS.
§ 8 Limitation of liability
WOIMS is only liable for damages attributable to gross negligence or intent. Liability for lost profit, indirect and consequential damages is excluded. WOIMS provides no guarantee for specific search engine rankings or conversion rates. WOIMS's total liability is limited to the amount of payments made by the Client in the last 12 months.
